I am on 10th year H1B now. I 140 and I 485(concurrent july’07) Denied due to EUCATION(3 year), Did appeal in 2008 that went to AAO, Got RFE on Appeal in Sept’09, replied RFE on Nov’09, No decision yet
* What should I do for pending appeal in AAO? How long it will take to get decision on Appeal after we submitted Requested Document. ?
*Can we contact AAO for the update as on website we have soft LUD but we don’t see that they have received the requested document against Appeal?
* Can I file new I140 based on I have another approved labor with EB3 for backup? If yes then what will be the status of OLD pending APPEAL ON I140 with AAO?
* Spouse (H4) is working on EAD (M.S.Mechanical) & will expire in Dec’10, should he covert H1B for backup? How he can file COS or New H1B?
