I need some advice on my dates of H1 and status in US.
I came to US on Jan 23,2004.I got my visa extension,once till 2008 then till Dec 11,2010.So my current stamped visa is valid till 12/11/2010.Since Jan 2004,I was on vacation for total of 5 months outside of US.As per my knowledge I can be in US for 6 years on H1.From Jan 2004 my 6 years end in Jan 2010.If I recapture my out of US 5 months,then 6 years will expire in Jun 2010.But because I already have the visa stamped till 12/11/2010 is my status legal in US after Jun 2010?Will there be any problem if I re-apply for any visa in future to come back to US(H1,L1,other visa).
My PERM Labor is in process for last more than a year.Should I apply/ask for H1 extension on basis of the pending labor by Jun 2010 or wait till Dec 2010?
