Q.

H-1B 1-Year Foreign Residencey Requirement

Dear Sir or Madam, I want to know if I have met the 1-year residency requirement to file for H-1B for fiscal year 2011. USCIS doesn't give any gudiance to what defines a "brief" visit. My trips to the US have been in B-1 in lieu of H but both my I-94's have just B-1 stamps.

Residency Dates:
1 year back from today is 04/02/2009:

04/02/2009 – 05/08/2009 (India) – approx 1 month 1 week
05/08/2009 – 05/31/2009 (US) – approx 3 weeks
06/01/2009 – 11/07/2009 (India) – approx 5 months 1 week
11/08/2009 – 03/26/2010 (US) – approx 4 months 3 weeks
03/27/2010 – Present (India)

Total presence in India in the immediate prior 1 year: 6 months 2 weeks +

If I am not eligible, how long must I stay in India to be eligible? Or in worst case scenario, does my residency "reset"?
