Need your advise and instructions. I-94 exp on Jan 23rd 2010 (due to my old passport expired) h1 valid till sep 2010. Got new passport. Employer filed LCA starting from today and said need to sign LCA once approved and apply for premium processing. My wife left to india on 20th Jan 2010 and don't remember when her I-94 expired.
What's my current status?
Do we need to apply for h1 ext when i-94 expired? (Employer told me that I am in illegal status and should have applied h1 ext in jan before i-94 expired)
Will my h1 ext get approved?
Will my wife face any problems when she is coming back?
Did u come across such cases in past?
What could be the consequences and response from USCIS?
What are my options and is this a serious issue?
