Q.

H1-B (Change of job)

Hi Indu,

Thanks for your great help. I have a question for one of my best friends. The incumbent has been working as a Civil Engineer for a consultancy who has hired her to a State DOT. Unfortunately due to lack of work her work has been made to 3 days a week. The consultancy is negotiating some other work with other agencies. I have the following questions:

1) In case she is laid off by her hiring company due to lack of work and then re-hired by the same agency, is it necessary for her to refile her H1-B (she has it approved last year)? What is the procedure for her to remain in status?
2) How many days can she legally stay in USA on a H1-B without work?
3) What is the minimum duration of work per week necessary for her to maintain status.
