Q.

Laid off, switched to B2, how to get back to H1B?

Hi,

I got laid off on March 10 and as advised by lawyers, I filed for a B2 visa citing time to pack up. I understand the processing for B2 will take 2 months or so. If, in the meantime, I find an employer who is ready to file my H1B, will it be a new H1b petition? If so, would you advise change of status or should I leave to my home country and then get it stamped? Also, will USCIS give me the new H1B with a start date of October or will the start date be what the new company requests?
