Q.

H1B and WH4

Got H1B from consulting company- Oct2009 for 3yrs. They took money as security deposit twice from me. They didn't give any job nor paid me for 6 months.Forced me to send an email leave application.I sent another email saying I am ready to join any time.They are now threatening to cancel my H1 on grounds of 'not reporting to work'. Not paying me return ticket.They are also giving reason of 'relocation constraint' on my part.At the time of filing H1 they said job is in my state and it was clear that I wont relocate as I have family.They are not paying me wages/security deposit/return ticket.
1.Is there any way to keep my H1 valid?
2.Will filing WH4 complaint affect my or my husband's GC application in future?
3.If they cancel H1, Will I have to reapply in April in cap or am I cap exempt?
