Q.

am i considered out of status.

L1A I94 expired 09/14/09. On 09/11/09 filed for L1A extens & H-4. approval on H-4 from 01/06/10. Got RFE on L1A & finally denied. Denial notice as follow. Am considered out of status? do i need to leave the country?

The decision resulting in the denial of Form 1-129 leaves the beneficiary without lawful immigration status. Absent an approved application or petition which would bestow valid immigration status upon him, he is now present in the United States in violation of the law. If the date shown on his Form 1-94, Arrival and Departure Record, has already passed, this Notice of Decision leaves him without lawful immigration status, and he is hereafter present in the United States in violation of the law. He is required to depart the United States immediately.
