Q.

H4 to H1 Transfer

1. I applied for H1 on April 2008 when I was in US on H4
2. I went back to India on May 2008
3. I got my H1 on October 2008 and got it stamped on 2009 Jan in India(valid until 2011 December)
4. Due to recession my employer delayed my travel
5. So I got H4 stamped on August 2009 in India and I traveled to US
6. Now (Mar 2010) My employer is asking me to apply for Change of Status as I got a project

My query is

1. Is it wise to go to Mexico or Canada and get it stamped (I have 797A form)?
2. Or can I go for a change of Status?
3. If its Change of status under premium category how long does it take and whats the fee?
4. If I apply for COS under premium category Can I start working once I get LIN number ?
