Q.

L-1 to H1-B

I came on L-1 visa and it's good until 2011. I applied for change of status to H1-B in 2010 quota. My H1-B was approved and the DOE on H1-B was oct,2 2009. Meanwhile I visited India on an urgent trip and entered into US on oct, 05 2009 by showing my L-1 visa. "I WAS GIVEN A FRESH I-94 AT THE PORT OF ENTRY. I DIDN'T APPLY A FRESH L1 OR THERE WAS NO FRESH STAMPING ON MY PASS PORT WHILE ENTERING INTO US. My question to you is , Am I on L1 or H1-B?. I am working still with the company who sponsered my L1. Now H1-B employer says that I am on H1-B on the basis of latest endorsement by USCIS. Please give your legal answer to the question.
