Extend expired H1B
Hi,
Thanks for providing such a wonderful platform for legal advice!
Following is my case:
My H1B 6 year expired on 09/29/09.
I filed for extension using recapturing dates I spent out side the US.
Extension got approved till 12/18/09.
I switched to student visa before 12/18/09 and still on Student visa. (I have CPT but I am not working.)
My labor(PERM) was filed on 04/27/09 and just got approved last week.
I want to switch my status from F1 to H1B.
Based on approved labor (EB2), Could I get H1B extension for a year?
Should I file for I140 and then go for H1B Extension?
My University semester ends on March 27th and before that I would like to file for change of status.
Please advice.
