Q.

H1B Petition

Hi,

My employer filed my H1B petition in April 2009 without change of status and it was approved.At the time of filing I was working on L1B.In Sep 2009 I filed for H4 status (got approved on Nov 13th)because the project for which the H1B was filed got shelved and I couldn't activate my H1B status. My question is if I get a job now with a different employer would I need to file H1B petition again under the 65000 cap or would it be cap exempted considering my previous H1B hasn't been revoked. Currently on H4.
