Automatic Visa Revalidation Question
1.I have an expired H1 visa on my passport. The expiration date is Aug 2008.
2. I had an H1 transfer and traveled out of US in Feb 2008. While returning back,the officer stamped Aug 2009 on my white I-94(date of expiry of new H1).
3. I did another H1 transfer late last year and I now have an approved I797 notice with expiration date of 2012.
4. I'm planning to travel to Canada for 7 days and want to know if I qualify for Automatic Visa Revalidation.
I'm confused because I read somewhere that "the individual must have an unexpired I-94 to use AVR".
I have an expired I-94(white form) but my new H1 approval notice (I797) has a I94 section at the bottom with expiry of 2012.
Do I have to have an unexpired white I94 form OR can I travel with an approved H1 notice(I797).
