PERM certification with new company
My 6 year of H1B ends on May 28 2011. I am with company A presently and I have PERM labor and I-140 approved with PD Dec 2008. I am being offered a direct position with the client I am working at.Job position/title for the direct position is the same as present. My H1B renewal is due in Sep 2010 and I am aware,if I continue with company A, of the 3year extension during that renewal.
Q1: Assuming I take the direct position with the client within a month from now, and then the usual H1B transfer time to the client, can the approved labor and I-140 from company A be used to extend my new H1B of the client beyond the 6 year? or would it be wise to wait until my H1B with company A is renewed by 3 years and then join my client as direct? How far ahead can my H1B renewed from date of expiry?
