Q.

Expired H1B Visa

My husband had H1B visa through company A. I797 had validity from 10/1/06 to 9/30/09. The H1B visa was issued on 12/16/06 through company A with 3 years validity which expired on 9/30/09. Can he make use of the same H1 for the next 3 years as H1B visa is valid for 6 years? If so, and if company B is willing to offer a job and file for an extension with the expired H1, how likely is his chance to get this approved?
