H1B Extension after 6 yrs! Urgent
Appreciate much if I get response by COB-03/02. My H1B six year limit expires in Jan 2011 but got the H1B recentely transferred to other company. INS gave H1B until Jan 2012 (1 year more that makes 7 yrs).Also I left country only for a month in these 5 yrs. My new company can't file labour until May of this year that leaves only 8 months before 6 years H1B Cap limit.But I was told that labor should be applied 1 year before 6 yrs period. Will this be a problem to get my labor approved? or I can stay legally until 2012 and meanwhile ny labor can get approved. My current Client (H1B company is different from client) offering me a fulltime but I doubt my H1B transfer will get until Jan-2012. And client cannot employ me if my 6yr cap ends in a year.Please advise.
