Q.

H1B to H4 COS

I am in my 7th year of my H1 visa and I have I-94 extended for 3 years till 2013. My I-140 is approved through the current employer. My employer has terminated my position as of March 15, 2010 and are going to revoke my H1B.

To remain in status, I am planning to apply for H4 COS as a dependent to my husband H1. During my H4 is in process, if I find a job that can sponsor me, will the new employer be able to apply for my H1 visa? Should I ask the new employer to apply for H1 COS or H1 transfer.

If so how soon will I be able to work with them, immediately after applying for H1 (when receipt notice is received) or should I wait till the visa is approved?

In this process do I required to go out of the country for visa stamping in the passport?
