Work Visa Options - H1/L1

Hi,
Got few queries specific to my work visa. Request guidance.

I had an H1B Visa issued in 12/2006 and expired in 04/2009 . I used that H1B for just one month in US. I have re-entered the US in L1B visa for the same company that did my H1.

Questions:

1. Will my H1B be cap counted as part of the 2006 list. If so, can I renew my H1B now?

2. If response is No, can I do a status change to H1B?

3. If response is still "No". Can I do a status change from L1 to a L2. My wife is in L1 status working in the US.

4. Can L2 status change be made without the knowledge of both mine and my wife's companies?

5. With L2 status change applied with me working in L1 Visa, will EAD and L2 status change come together in >90 days, avoiding joblessness during the 90 day period?

Thanks
