H1-B expiring; have filed I-130
H1-B expires in a matter of days. Employee is filing for extension based on time out of the country. Employee wants to keep me. Jan-10 I filed I-130 based on marriage to Permanent resident. Wife filed N-400, has priority date Jan-26-2010, has Biometrics pending (in a few days). ICIS gave verbal advice today that I can stay on my present status (H1-B) unless my wife's N-400 petition is rejected. Does this make sense? It doesn't to me. Are there any other options for my staying in the country, with or without working?
