OPT STEM And H1B Visa

I am currently on F-1 status working with my OPT STEM.My employer also filed for an H1B petition that didn't include automatic change of status. The H1B petition for consular processing was approved, but I was laid off before october 1st due to the problems with the economy. My attorney told me that I could begin new employment because I still on F-1 status with a valid OPT.I got a new job with an E-verified employer 2 months after I was laid off.I am looking for a second opinion,am I in a legal situation as my attorney said? I was also told that even though I never got to change to H1B status with my previous employer,I still have my H1B number. That I can still file for a transfer of my H1B number to my new employer before my OPT STEM extension expires. Is my attorney correct? Is this true?
