Physician H1B Portability
3rd yr resident physician with exempt H1B looking to transfer H1B after program. Will I subjected to H1B cap if transferring to for profit employer? If yes, will i be required to file for H1B by Apr. 1? Am i exempt from cap if transferring to not to profit (including coop) employer? Can H1B be filed by different employer? Can i deduct FMLA leave (sick during pregnancy) taken during residency 3yr H1B period? I plan to extend my residency by 2 months before moving to employer because I took FMLA leave for 2 months.
