Q.

H1B - Out of Status - H4

Have H4 stamped on passport valid til Nov 2010.Applied COS to H1 & H1 petition,approved with Oct 1 starting date.SSN received Nov 09.Im on bench w/out pay.No paystubs from Oct 09.Heard employer can start paying employee after 60 days if already in the US,is this true?Can this be applied on me?What proof do I need to give USCIS that I started working in Dec 09 & not Oct?Am I out of status from Dec. 09-Jan 2010 or Oct 09-Jan 2010?Can my employer still give me my salary for the month of Dec.2009 & Jan. 2010 in Feb 2010?
If I go back to my country in Feb can I come back here using my H4 on my passport,H4 valid till Nov 2010?What problems will I have if I am out of status for 2-5 months (apply for visa stamping in my country,COS from H4-H1 in the US or my greencard,3-10 yrs bar on reentering)?
