Q.

COS from H1B to H4

My wife is currently on H1B visa & is planning to change status to H4 based on my H1B visa. She is committed to a project until Jan 31, 2010.

1) What documents do we need to file her COS from H1B to H4?

2) If we file her COS before Jan 31, 2010 and have a receipt from USCIS but not approval (since it takes time for approval). Would that mean she is out of status after Jan 31st until the COS to H4 is approved since she will not be working after Jan 31st, 2010? What will be her visa status during that time?

3) If we receive the receipt notice but not approval for H4 before Jan 31, 2010. Can she work until Jan 31, 2010?

4) I think she can apply for a new H1B later without having to be part of the H1B quota. In that case, what documents would we need then to reapply for H1B.
