Q.

H1 B & H4 EXTENSON-TRAVEL TO INDIA DURING THE PROCESS

My H1-B expires on May 15th, 2010. 6th yr will end in Dec’11.
Applying for extension-Dec-09 for both me and spouse. We are travelling to India and will return back to us while this extension is in process. (We hope we receive the approval before we leave but we don’t know the processing timelines). Also when we return my wife and I will have 4 weeks of visa left on the passport. Will this pose a problem at port of entry? I will be having the receipt numbers from our extension request.
Can one leave the country while their extension request is in process?

My wife had H1B before but could not work because of pregnancy and her employer revoked H1B. Also my wife plans to apply for H1B once we come back. Will this be a new H1B (under cap) or just H1 transfer (cap exempt)
