Q.

H1 - H4 - H1 transfer

Hi Andrew,

I was on H1B with my current employer from April 2008 until Jan 2011. I then applied for H4 on my husband’s H1B as my employer informed me that my project was ending. I have received a USCICS receipt dated 10/07/09. The complication now is that I have found another employer who wants to employ me and sponsor my H1B.

So the options I have are:
1.Apply for H1B transfer from my old company (which has still not been cancelled) to the new company
2.Apply for new H1B and simultaneously cancel my H4 processing
3.Apply for new H1B only

Also can I travel to India on my current H1B and carry my transfer documents?
