i have appealed pending 485, i140, i reentered US with AP on Oct 2009, i am also on H1 Visa expires Jan 2010, H1 extension is pending.filed before i left.
,there is memo in USCIS says when i enter US on AP and have unexpired H1, i can resume working on h1 with same employer as long as 485 pending, and it returns me back to H1 visa status as long as the same empolyer
1:should I send letter with my new I 94, or new application I 129 for reinstatment ( and also h1 extension pending) just in case appeal denied.
2: when i was overseas i enterd US embassy for H1 visa stamp, they called my family to get visa stamped after i left, does this action affect H1 extension?
