Q.

Help with I539 : H1B - H4 visa status change

My 6yr H1B period is ending(11/09) and am changing status to H4 based on spouse's H1B.My labor had been filed&approved for a future employment position.Though I have not filed H1B or I-140 with this employer since I haven't found any contract job. I am working full time with another employer and will have to stop working in Nov 09. I need help with Part 4 question 3a&3b of I539.
3a:Are you an applicant for immigrant visa? Ans:Yes Explanation: Immigration Visa was filed for future contracting opportunity and the labor was approved as well, but since i have not been able to procure any contract jobs i would like to move to H4 status.
3b:Has an immigrant petition ever been filed for you? Ans:No(this I believe refers to I140)
Please let me know if the ans and explanation look right to you.
