Q.

COS H1B to F1, then to H1B

I was working with Company A on H1B until September 30, 2009. My company did not apply for H1B extension since they could not find a project for me. I have completed 3 years on my first H1B.

I applied for COS to F1 on September 23, 2009 and got the receipt from USCIS on Sep 28, 2009.

Now I got a job from Company B.

Question:

1. Can Company B file for H1B transfer? Can a gap of 12 days create a problem in the H1B transfer approval? My visa with Company A expired on September 30, 2009.

2. Does Company B need to file for COS from F1 to H1B?

3. When is the best time to withdraw the F1 COS application? What form does one need to submit?
