I'm in USA on H1B. My wife's H1B petition got approved in 2008. She is in India and her H1B stamping is yet to be done. Since the consultant through which we have applied H1 is not willing to provide Client Invitation letter which is essential during H1B Visa Interview, I would like to bring her on H4 visa and later apply for COS to convert to H1B. 1)Can she apply for H4 though the H1B petition is approved.If yes,what are the H4 rejection chances 2)I was told that if H1B is approved when the person is not in US, he can't apply for COS from H4 to H1. Even COS is applied, he has to go out of US and get H1B stamping done. Pls clarify 3)Can she come here on H4 Visa and find a job. Once she get the job(Offer Letter),can she go back to India and get her H1B VISA stamp using the offer letter.
