Q.

E-3 Australian Specialty Worker stamping in India 221(G)

Hi
My wife came to US under H-4 visa. issued on her Australian Passport in Sydney. The visa is valid until 15 Oct 2012. In November 2010, her company filed for change of Status to E-3 Visa and she started working for them from February 2011. She visited India in January 2012 and applied for E-3 Visa stamping in New Delhi and received a 221(g) Green. She has submitted all the documents, but my EB-2 priority date is current and wish for her to be in US to file for 485. If she withdraws her application for E-3, can she travel back on her H-4 visa provided Delhi Embassy does not cancel her H-4 visa? Or would she need to apply for a new H-4 visa?
