I went to India for vacation in Dec 2009 with newly approved H1B which is valid till Oct 2012. I got my H1B visa stamping till Dec 2011. While entering the US, my 1-94 was issued till Dec 2010 as my passport was expiring in Dec 2010. I renewed my passport but didn't know that I have to renew my I-94 also. I assumed since I have a valid H1B visa and stamping I can continue to work legally.


Is it true that I need to have valid I-94 along with valid H1B visa to stay in US legally? If so, what are my options now? Can I go out of the country and get new I-94 with my valid I-797? Please advise me.
