Q.

Staying in H1B beyond 6 years, H1B/PERM clarification

Hi
My 6 years in H1B will be over by October 2012. I transferred my H1B from Company A to B using my I-140 from Company A. New I-797 is upto 2014(I-94 till May 2014). Company B will start GC on July 2012.

1. If company A withdraw I-140, is it OK to stay in US beyond October 2012(i.e 6years) with an approved I-797 till 2014 or do I need Labor/I-140 from Company B to stay beyond 6 years.

2. I am expecting my Masters in June 2012. Can I use the Master gained while working with current employer for PERM/I-140 process.

3.Also if I tranfer my H1B from Company B to C, will get H1B extension till 2014(i.e current I797 validity).
