H1B Amendment Needed or LCA is fine?
I am working as a consultant at Client A (E-V-C Model) and i recently got visa extension until Dec 2012.Now i am planning to move to Client B which is 10 miles away from Client A.
Job responsibilites and Title are going to be the same.I am applying for LCA.
Our Employer's Immigration attorney said that i dont have to apply for Amendment since the new client B is in less than 20 miles from Client A. He said it should be fine if we just apply for LCA
My current H1B will expire on Dec 2012. I probably need to apply for extension again in July 2012. So if i move to the new client, the LCA and I129 will be different.
Will that be an issue? If USCIS gives RFE, can we defend saying that the clients are in less than 20 miles distance?Also what If USCIS ppl visits clientA & doesnt find me?
