Q.

H4 to H1 conversion

My wife is right now H4 status and has a valid visa. She worked in U.S for couple of months on an H1B valid from Oct 2008 - Sept 2011. She got COS from H1-H4 in April 2010. Right now, she is on H4 and at the same time her H1B is expired.
Can she apply for new H1 exempt from regular H1B quota ? In otherwords, can she apply H1B based on her old H1B without waiting for 2013 quota?
Please advice in detail.
