Q.

Got H1 with out I-94

Company 'A' applied H1 extension for me on 8/04/08 extension was pending for more than 5 months bcoz of 'Back ground check', mean time my US Visa & I-94 expired on 8/30/08. On 2/03/09 I got my H1 transfer approval with out i-94 for company B which i applied on 1/08/09 and the reason stated the pending approval for earlier apllied H1 extension. can we put a motion on my approved I-797 to get my I-94
1) if yes, how long it will take to get I-94 if i go through a reputed attorney like you, it will be before 03/29/09, if i stay above 180 days after my I-94 expiration will i be stopped to enter US for 3 yrs
2) if no, are the days from 8/30/08 to the day(which is before 180 days) considered illegal stay? and how it effects my future prospects in H1 Extensions and green card and extensions
