Q.

Parallel H3 to H1B

Hi,

I want to ask whether it's possible for file another H1B petition while one H3->H1B case already exists and is pending.

I was on H1B since Oct.2008, but changed to H3 on Sep.2009, which is valid until 2011. A company filed H1B(regular processing) for me in May 2010. I got the receipt notice dated on Jun.3 2010. It's been 4 months but hasn't been approved yet. Now I want to change my employer. Will I be able to do this or have to wait until the approval of the first petition? If I don't need to wait, can I use premium processing to get the answer in 15 days?

On the other hand, if I wait until the approval of first H1B petition, do I have to work for the first employer for a minimum 30 days before file a H1B transfer to another company?
