Q.

Received RFE for 1st H1B Extension. Need advice.

I am a permanent full time employee at a small company for the past 3½ years on H1B which expires on 09/30/2010. My employer filed for H1B extension in March 2010. We received an RFE on 08/19/2010 asking for proof of specialized project work for the next 3 years. We sent the documents back on 08/25/2010. I also have an I-140 approval dated 07/07/2010.
1. What would happen if I don’t get a status update from USCIS before my H1B expires? Can I continue working while my status is pending?
2. Do I need to update my application to premium processing? If so, would the premium processing apply until the final case notice or till another RFE?
3. This is my 1st H1B extension appln., do I need to submit my I–140 approval to the USCIS? (It was not part of the documents sent in response to the RFE)
