Q.

L1A to H1B transfer and filing GC with only 11 months left

I am currently on L1A blanket since Apr 2006. Planning to shift to H1B to get a GC on H1B. Duration of stay in US coming out to be 5 years excluding all stay outside of US(vacation etc..). Have about 11.5 months left for the max duration of 6 years(if I switch to H1b).

In the present situation, how risky is it to switch to H1B, file labor, 140 and then EAD/GC filing having only 11 months left? Will this time be enough to get labor and 140 approved to get advanced parole to extend the stay?

I am from India and my wife is from PERU. Can I use her priority dates in GC processing?

My in-laws are US citizens, but not my wife(not GC holder also). Is it good to apply GC through family based or employment based? or applying both at the same time creates any hurdles?

Please advise.
