If you can prove your lawful entry into the U.S., which you probably can do just by showing your Canadian passport, then you are eligible to file for adjustment of status based upon your U.S. citizen spouse's immigrant petition for you. If you got maried or if you file within the first 30 days after entering the U.S. however, be prepared for questions about your possible "preconceived intent," that is, that you pre-planned to enter the U.S. as a visitor but you really intended to immigrate. |
