How can I withdraw Perm in audit if I change my job?
Fragomen took over my perm case on June last year, it took them almost a year to submit my case on May this year, and then, it got audited. So frustrated!
Now I get a new job offer from another company and this company agrees to start the perm application as soon as possible.
My question is, as I am already in an audited perm application. Can I start a new perm application in the new company right away? Is there anything I need to do to withdraw the perm application? Or because I change my job, the audited case will be withdrawn/cancelled automatically?

You can't withdraw the PERM, only the employer or the employer's attorney can do that. Also, once a PERM has been audited, the withdrawal request also should address the issues raised by the DOL in the PERM audit, in order to avoid problems with using the DOL PERM system in the future for that employer. Of course, if you do not intend to work for that employer, then it is really not a concern for you.
Your new employer/sponsor may prepare and file a new PERM whether or not the first employer's PERM is audited, withdrawn or even denied. |
