Change of status to F1
1)Candidate came with visitor visa as dependent
2)became F2 dependent
3)Became H4 dependent
4)became student of Taxes A&M University holding H4 status
5)He lost h4 status because his father was laid off few months ago
6) His father applied for visitor status including him. (Status approved, notice date May 2008, but already expired in Feb 2008!)
7)Another company promised future job and applied I-140 for his father before his layoff. (pending now)
his name is listed in that application
9)He is still a full time student and needs only 2 more semesters to finish his 4 years UG program
10) Can he apply for F1 status explaining the extraordinary circumstances
11) what are the chances for the approval?
12) if denied what will be the consequences?

His chances are not good for approval, but I don't know that he has any better alternatives than to try for F-1 reinstatement. If denied, he will not be in any worse shape, but he should probably leave the U.S. before accruing more than 180 days of unlawful presence. He should contact the school official in charge of foreign students and ask for a new I-20 and reinstatement of F-1 student status. |
