Q.

Two I-140

My employer filed for first I-140 Feb.2007 at NSC. When visa became current last July 07, another I-140 was filed concurrently with I-485 at CSC mistakenly by attorney and it was later transferred to TSC on Oct.07. On May 16,2008, the first I-140 was transferred fr NSC to TSC(same service center of 2nd I-140).I have spoke with IO fr TSC and they said that 1st I-140 was relocated.How are they going to process two I-140?

A. The rule is that you cannot have two identical I-140s on file at the same time. When it comes time for the second one to be adjudicated, USCIS should send the employer a notice requesting that the withdrawal the second I-140. This should not affect the first I-140, which hopefully will be approved by that time.

Q. Can I change my lawyer for representing the I-140,because I wanted him to make a service inquiry regarding my case and he said he can't since it's outside the processing time.But first I-140 was applied 1 year and 4 months since June 08?

A. You can always change your lawyer, for any reason. If you are not confident in your lawyer's ability to represent you, then you should consider terminating his or her representation. This usually should be done in writing. Please keep in mind that you may owe outstanding legal fees, which you still will owe, even if you change lawyers. Also keep in mind that if you retain a new lawyer, you will have to pay a new legal fee, which may increase the overall amount of legal fees you would have paid if you had stayed with the first attorney.

Based upon your email, I do not see any reason for you to doubt your attorney, or any reason why you should change your attorney. If the case is not within processing times, then no inquiry should be made. The current processing time for I-140 petitions at the Nebraska Service Center is March 22, 2007. Perhaps you could ask your attorney why he thinks that your petition is still withing normal processing times. He has all of the information; he may be able to explain the situation to you.
