how can I switch from B-2 to H-1 visa?
Attorneys please help. I am currently in US on a valid B-2 status. How do I change my status to H-1B and start working here in US? Is it possible, and what do I need to do?

Unfortunately, there are no visa numbers available for new H-1B petitions. The deadline to file was 04/01/08 for a start date of 10/01/08. In addition, there was a random selection process (lottery) because the demand for the H-1B visa numbers exceeded the quota. The next H-1B filing date for new petitions will be 04/01/09 for a start date of 10/'01/09. This situation will continue unless and until Congress adds new H-1B visa numbers. Hopefully, this will happen next year.
If you are in B-2 status, you must file either an extension of status if you do not plan on studying or working, just visiting, or a change of status to another category, such as F-1 student, for example, if you plan on studying fulltime in the United States. |
