Q.

Green Card and illegal stay

can someone get a green card if he's staying illegal in the US for around a year, but his Mom has sponsored him for a green card and the date has arrived to file for the green card. And if not what is the procedure that he should follow in order to get the green card, and will he get punished for staying illegal for a year? and how long does it take to get his green card? and will he be able to enter the US ? by the way he was over 21 when him mom filed for his green card.

he was following what the paralegal who helped him file his case to stay in the U.S. to get better chance for the green card. he didn't know he was illegal staying until now--which might have been 1 year since the company terminated his H-1B.
