Q.

US Citizen filing I-485 for non-resident spouse

I am a US citizen who recently married an EU citizen and would like to file I-130 and I-485 forms for my spouse. He entered the US on a multiple entry B1/B2 visa that is valid for 10 years, but only allows him to stays for 6 month periods. He has since overstayed the 6 month term. Will he have to go back to his country and wait for approval if I file the I-485 or will he be allowed to stay in the US while the paperwork is processing?
