My wife (German) has been accepted and received financial support for a US PhD program, which begins at the end of August. I submitted the I-130 (and attendant forms/proof) for consular processing in Frankfurt a month ago without realizing that it would take a year for the visa to eventually be issued. I have only now just received a payment receipt from Frankfurt.

I was also considering the expedited process of a K3, but the time frame seems too short at this point. So, I am considering canceling the I-130 petition and having my wife try to obtain an F1. However, I am aware that the intent to be a non-immigrant does not seem logically compatible with marriage to a US citizen.

My basic question is whether it is possible for her to get an F1 while being married to me.
