Q.

Changing from Greencard through work to family greencard

I am an Indian national, born in India, living in the United States working on an H1B visa. I received my H1B for the first time in 2009.

My employer wants to begin an employment based greencard next month (Feb-2012).

I am dating a US citizen, and we plan to get married in late 2013 or early 2014.

My questions is, by the time I am married & able to file for family based greencard, My employer will have completed PERM and most likely filed I-140. I will be waiting for priority date to become current. At this point, can my spouse file a family based greencard? Does the employment based I-140 get canceled automatically, or I have to notify USCIS that i am no longer pursuing greencard through work.
