Q.

green card

My I-130 was approved in 2007 thru my wife who is a U.S citizen but I could not adjust status due to EWI.Also my asylum application was pending at that time which was just granted in June 2010.Now I want to file for a green card based on my I-130.My attorney told me that since I have an EWI,I have to first get a travel document and get a valid re-entry into U.S to be eligible to file for a green card.But then I went to a USCIS office and they told me I could file it without doing that but I have to pay $1000 as a fine in addition to filing fees.I am confused,is my attorney right or the USCIS office? I am not planning to wait for 1 year to file green card based on my approved asylum.I also got my travel document, but would rather pay the fine and do it if possible.Please advise.
