Q.

Green Card and H1B

Hi I am in the process of marriage based GC application (I just got my biometric done today). Now there is a company that would like to sponsor me H1 (I was on H1 for a year and it was terminated in this Feb so basically they just need transfer my H1B). My situation is I was enrolling in a community college and was on F1 since summer, but after I turned in my i-485 I did not register for the fall semester (the last registration day is 10/25), so what status am I maintaining right now? Still F1? or COS? If I am a COS, am I still eligible to work as an H1B? For some reason I did not tell the employer about my GC, do you think it is possible that they could go ahead transfer my H1B before USCIS finds out I quit school and not an F1 anymore? I really need this job! Thanks!
