Q.

I-130 Through Brother At NVC - Would Like To AOS

I have an I-130 from my brother for which the NVC just sent us the choice of representative documentation, meaning it is becoming current very soon. I am in the US on H1b, which expires in Sept-2011. I would like to AOS. Due to the H1b being only one more year I would like to file I-485 concurrently, when beginning the process with USCIS. It is just always unpleasant to depend on employer for extension.
Can I file a second I-130 with USCIS using the priority date from the case filed with NVC so I can claim a current priority date and file the I-485 concurrently?
If so I was wondering which steps I would have to take for that?
I was also wondering if you could recommend another approach?
